Licences, seasons and using the hunting guide
Why this matters
As with fishing, the state lets you consult the current hunting regulations guide during this exam. That tells you the exam is testing whether you can find and apply a rule, which is the same skill that keeps your clients out of trouble.
By the end of this lesson you will be able to
- State New York's hunting licence and hunter education requirements
- Navigate the hunting guide to a specific season, WMU and legal implement
- Apply the discharge setback distances and the transport rules
Licences and education
- A hunter education certificate is required before a first hunting licence, and a separate bowhunter education certificate before a bowhunting privilege. They are free, they are one-time, and they are honoured from other states
- Hunting licences are sold by age band, with junior privileges for younger hunters and a mentored programme that requires a qualifying adult to accompany them. The specific ages, mentor qualifications and which implements are allowed change, so read the current guide rather than trusting anyone's memory, including this course's
- Add-on privileges are separate: bowhunting, muzzleloading, turkey permit, Deer Management Permits (issued by lottery for antlerless deer in particular units)
- Every client hunting must hold their own licence and privileges, and carry them. Check them yourself before the vehicle leaves
- You need your own licence too. ECL 11-0533(3) exempts guides from needing a sporting licence except when guiding for hunting or fishing
Finding the rule
New York is divided into Wildlife Management Units (WMUs), and almost everything, season dates, implements, antler restrictions, DMP availability, varies by WMU. The three questions to answer for any hunt, in order:
- Which WMU am I in? The map is in the guide and units follow real boundaries. Know yours, and know when a property straddles two
- What is open, and to what implement, on this date, in this WMU? Archery, muzzleloader, regular firearms and crossbow all have their own windows, and they differ between the Northern and Southern Zones
- What may be taken? Antler restrictions apply in some units, DMPs are required for antlerless deer in most, and turkey has bag limits by season
Legal shooting hours for big game in New York run from sunrise to sunset, adjusted by a published table for the region and date. Migratory birds have their own federal framework. Do not calculate this in your head at 05:40; have the table.
Where you may shoot
| Implement | Minimum distance from a dwelling, school, playground, occupied factory or church, farm building or structure |
|---|---|
| Firearm | 500 feet |
| Crossbow | 250 feet |
| Longbow | 150 feet |
The exception is narrow: you own or lease the structure, are an immediate family member or employee, or have the owner's consent. As a guide you will often be working ground where this is the binding constraint, and it is your job to know where the lines fall, not the client's.
Transport and possession
- Long guns must be unloaded in or on a motor vehicle, including in the magazine, and this includes ATVs and boats under power
- Loaded muzzleloaders count as loaded. A capped or primed muzzleloader is loaded
- No shooting from, on or across a public highway
- Know the tagging and reporting rules: New York requires big game to be tagged immediately and reported within seven days, and some units and species require a check
- Chronic wasting disease rules restrict importing carcasses and parts from other states. If your clients travel to hunt, they need to know before they load the truck
From the field
A client wants to take a shot at a deer standing 400 feet from a barn on the neighbouring property. You do not weigh it up. Four hundred feet is inside the 500-foot firearm setback, and the barn is not yours. The shot does not happen, and you explain why afterwards, not during.
